These Terms and Conditions ("Terms") govern your access to and use of hjbullion.com (the "Site") and any purchase from or sale to HJ Bullion ("HJ Bullion", "we", "us", or "our"). By using the Site or transacting with us, you agree to these Terms. If you do not agree, do not use the Site.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for activity under your account and for keeping your credentials secure. Non-staff customers verify a mobile phone number before account access.
Pricing and product information
Precious-metals prices are based on live spot prices and change continuously. Prices shown include our premium (for purchases) or reflect our buy price (for sales) and may change without notice until an order is locked. We strive for accuracy but do not warrant that descriptions, images, weights, or prices are error-free. We may correct errors and reserve the right to refuse or cancel an order arising from an obvious pricing or description error, even after it is submitted.
Orders and acceptance
Your order is an offer to purchase. A contract forms only when we confirm and lock your price and accept the order. We may decline or limit any order, including for suspected fraud, pricing errors, or unavailable items. Because metals prices move, your price may be confirmed at the time of order or payment as described at checkout.
Payment
We accept the payment methods shown at checkout. We offer a discount for payment by bank transfer (wire or ACH) compared with card payment; this is a discount for non-card payment, not a card surcharge. Card and bank payments are handled by our payment processor, and you authorize us, through that processor, to charge the amount shown. Orders are not final until payment clears.
Market risk and returns
Precious-metals products are priced on a volatile market. Except where required by law, all sales are final. If we agree to accept a return or cancel a confirmed order, you are responsible for any market loss (the difference between our buy and sell price at the time) plus applicable fees. Returned items must be unopened and in original condition where applicable.
Shipping and risk of loss
We ship by insured, trackable methods appropriate for precious metals. Title and risk of loss pass to you upon delivery to the address you provide. You agree to inspect shipments promptly and report any discrepancy within the window stated on your order.
Selling to us (buyback program)
Any offer we make to buy items from you is conditional and subject to physical receipt, inspection, and authentication. You represent that you own the items free of any liens and that they are authentic and accurately described. You are responsible for shipping items to us as instructed; we may provide an insured, prepaid label. After inspection we confirm or revise the offer, and if you decline a revised offer we return the items. We may require identity verification before payout and may decline items at our discretion. Payment is made after inspection by the method we agree.
Legal and compliance
Precious-metals transactions may be subject to identity-verification, recordkeeping, tax-reporting, and other legal requirements. You agree to provide information we reasonably need to comply, and you are responsible for any taxes arising from your transactions except those we are required to collect.
Acceptable use and intellectual property
The Site and its content are owned by HJ Bullion or its licensors and are protected by law. You may not copy, scrape, resell, or misuse the Site, interfere with its operation, or use it for any unlawful purpose.
Disclaimers
The Site and services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. Nothing on the Site is investment, tax, or legal advice. Precious metals carry risk, including loss of value.
Limitation of liability
To the fullest extent permitted by law, HJ Bullion will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim will not exceed the amount you paid us (or we paid you) for the transaction giving rise to the claim.
Indemnification
You agree to indemnify and hold HJ Bullion harmless from claims arising out of your breach of these Terms or your misuse of the Site.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in Los Angeles County, California will have exclusive jurisdiction over any dispute, except where applicable law provides otherwise.
Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted, and the "Last updated" date above reflects the latest version. Your continued use of the Site means you accept the updated Terms.
